The short version: Use Yayby responsibly and for its intended purpose (capturing your own family's baby memories). Unlock purchases are handled by Apple; printed baby books are fulfilled by Prodigi and non-refundable after shipping. Yayby is provided as-is with the usual software disclaimers.

1. About these terms

These Terms of Use govern your use of the Yayby iPhone and iPad application and the yayby.com website ("Yayby", "the App", "the Service"), operated by Andrew Hingston ("we", "us", "our"), an independent developer based in Australia. By downloading or using the App, you agree to these terms. If you don't agree, please don't use the App.

2. Eligibility

You must be at least 13 years old to use Yayby. Parents and guardians are responsible for the content captured about children under their care.

3. Your content

You retain all rights to the photos, videos, voice notes, and written content you capture in Yayby ("Your Content"). Your Content is stored in your own iCloud account — not on Yayby's servers — and is governed by your Apple ID's terms.

You are responsible for ensuring you have the right to capture and store any content in the App (for example, photos that include other people). You agree not to use Yayby to store illegal, infringing, or harmful content.

4. The one-time unlock

Yayby is free to download and try. A one-time unlock (US $59.99) unlocks every core feature of the App forever for the Apple ID that purchased it. The unlock is not a recurring subscription. Purchases are billed by Apple through your App Store account and are subject to Apple's standard terms.

Refunds for the App unlock are handled directly by Apple via reportaproblem.apple.com.

Growth tracking is reference data, not medical advice. Yayby's WHO percentile charts are for personal reference only. For any concern about a child's growth or development, consult a pediatrician or qualified healthcare provider.

Data preservation. Yayby stores your baby content in your own iCloud via Apple's CloudKit. Apple's iCloud service provides the underlying durability guarantee. We cannot recover content lost due to iCloud issues or account deletion beyond what Apple's own tools support. As a belt-and-braces approach, we strongly recommend ordering a printed book for offline durability.

Service availability. Yayby's backend handles unlock verification and print-book orders. While we aim for high availability, we don't guarantee uninterrupted service. Core app functionality (capture, browse, iCloud sync) works independent of our backend.

8. Limitation of liability

To the maximum extent permitted by law, Yayby is provided "as is" without warranty of any kind. We are not liable for indirect, incidental, or consequential damages arising from your use of the App, including loss of data, lost profits, or emotional distress. Our total liability for any claim relating to the App is limited to the amount you've paid us in the 12 months preceding the claim.

Nothing in these terms limits rights that cannot legally be limited — including consumer rights under Australian Consumer Law, UK Consumer Rights Act, EU consumer protection rules, or equivalents in your jurisdiction.

9. Termination

You can stop using Yayby at any time. You can wipe all backend data associated with your device using Settings → Delete My Data. We reserve the right to suspend accounts that violate these terms (for example, fraudulent print orders).

10. Changes to these terms

We may update these Terms of Use from time to time. Material changes will be reflected on this page with an updated "Last updated" date. Continued use of Yayby after a change constitutes acceptance of the updated terms.

11. Governing law

These Terms are governed by the laws of New South Wales, Australia, without regard to conflict-of-laws principles. You may bring claims in your local jurisdiction where required by law.
